Terms of service

1. Scope
These General Terms and Conditions (GTC) apply to all purchases from Atelier Tibet GmbH, Münstergasse 10, 8001 Zurich, Switzerland (hereinafter «Atelier Tibet»), made through the online shop ateliertibet.ch or by telephone or e-mail. Contact: kundendienst@ateliertibet.ch

The version of these GTC published on ateliertibet.ch at the time of the order applies. Atelier Tibet may amend these GTC for future orders. Deviating terms of the customer do not apply.

The online shop is intended for customers residing or domiciled in Switzerland or Liechtenstein.

2. How a purchase is concluded
The products in the online shop do not yet constitute a binding offer. By placing an order, the customer submits a binding offer to purchase. The customer then automatically receives an e-mail confirming receipt of the order. This e-mail does not mean that the purchase has been concluded.

The purchase is concluded as soon as Atelier Tibet confirms the order, ships the goods or makes them available for collection.

If, contrary to expectations, a product cannot be delivered or a price was obviously stated incorrectly, Atelier Tibet will inform the customer promptly. Any amounts already paid will be refunded in full.

3. Products and prices
Atelier Tibet describes and photographs all products with care. Nevertheless, slight differences in colour, size or appearance are possible, for example due to different screens.

Many products are handmade, so each piece is slightly different. Such natural variations are not considered defects. For online orders, Atelier Tibet selects a beautiful piece. If the customer does not like it, it can be exchanged for another piece at the shop in Zurich within 14 days of receipt.

All prices are stated in Swiss francs (CHF) and include VAT. The price at the time of the order applies.

4. Payment and vouchers
Payment is made using the payment methods listed in the online shop.

Vouchers from different promotions cannot be combined and are not valid for goods that are already reduced. Gift vouchers cannot be redeemed for cash.

5. Delivery and collection
Ordered goods are either delivered by post or collected at the shop in Zurich.

Goods are shipped with Swiss Post throughout Switzerland and to Liechtenstein. Shipping costs are CHF 5.00 per consignment; for orders of CHF 150 or more, shipping is free of charge. For bulky items such as furniture, shipping costs are calculated individually and communicated in advance.

Delivery usually takes 2 to 3 working days. Only products in stock can be ordered.

Atelier Tibet bears the risk until the goods reach the customer or are collected. If a parcel is lost or damaged in transit, Atelier Tibet covers the loss.

For collection at the shop, the customer receives a notification as soon as the goods are ready. If they are not collected within 14 days of this notification, Atelier Tibet may cancel the order and charge a handling fee of 10% of the order value.

6. Inspecting goods and reporting problems
The goods should be inspected immediately upon receipt: Is everything there, is it the right item, is nothing damaged?

Transport damage as well as incorrect or incomplete deliveries must be reported within 5 days to kundendienst@ateliertibet.ch. Please keep the affected goods in their original packaging until Atelier Tibet provides instructions on how to proceed.

Defects that only become apparent later must be reported immediately upon discovery.

7. Defects and warranty
If a product is defective, Atelier Tibet will repair or replace it. If this is not possible or is unsuccessful, the customer may choose between returning the product for a refund of the purchase price or an appropriate price reduction. Defects can be claimed up to two years after receipt of the goods.

Damage caused by normal wear and tear, improper handling, falls, impacts, moisture, natural events, or the customer's own modifications or repairs does not constitute a defect.

If a manufacturer provides its own guarantee, this applies in addition. A repair or replacement does not extend the original period.

8. Returns
Atelier Tibet voluntarily grants a 14-day right of return. Within 14 days of receipt, goods can be sent back by post or handed in at the shop in Zurich. The goods must be unused, complete and, if delivered packaged, in their original packaging.

The costs of return shipping are borne by the customer. Atelier Tibet refunds the purchase price, including the original shipping costs, within 14 days of receiving the return, using the original payment method.

Products made specifically for the customer, such as self-designed bracelets, cannot be returned.

9. Liability
Atelier Tibet is liable for damage caused intentionally or through gross negligence. Atelier Tibet is not liable for slight negligence to the extent permitted by law. Mandatory statutory liability rules, in particular the Swiss Product Liability Act, remain reserved.

10. Invalid provisions
If any provision of these GTC is invalid, all other provisions remain in effect.

11. Applicable law and place of jurisdiction
Swiss law applies. The UN Convention on Contracts for the International Sale of Goods (Vienna Sales Convention, CISG) does not apply.

Consumers may bring claims in Zurich or at their place of residence. In all other cases, Zurich is the exclusive place of jurisdiction.

12. Data protection
Information on how Atelier Tibet handles personal data can be found in the privacy policy on ateliertibet.ch.

13. Texts and images
All rights to texts and images on ateliertibet.ch belong to Atelier Tibet or its partners. Use is only permitted with express permission.
